Oooohh...stumbled across this thread whilst perusing the archives...muahaha...

The Constitution of NBardania

Preamble

We the people of the territory of NBardania in order to preserve anarchy and all around chaos, from which, and only which, we can derive true and perfect order, do hereby lay down the following laws for governing ourselves (or lack thereof).

Article 1- Boundaries

NBardania is the said virtual territory existing on CobraCards. the center of the territory is the mind of NBarden and the distance around his mind of the ranger of a .30-06, with complete control of the territory being its effective range, or approximately 1000 yards of virtual space, and arbitrary control over the ground of which the maximum distance a 30-06 bullet can travel, or approximately 4500 yards of virtual space. Thus, the area over which the sovereign government of NBardania excercises total control is 3,140,000 square yards or approximately 1.01 squre miles, while arbitrary control is held over a territory the span of 63,585,000 square yards or approximately 20 and 1/2 miles in virtual space from the location of NBarden's mind.

Article 2- Laws for Governing NBardania

Section 1- Official Ammunition of the State


All citizens and visitors of this country are hereby issued a .30-06 caliber rifle along with several hundred rounds of ammunition, as well as a special NBardania issued handgun chambered in the .30-06 cartridge. All parties are responsible for their self-defense upon entering the dominion of NBardania.

Section 2- Taxes

To provide for government funding of arms to the populace, a territory-wide sales tax on any caliber of ammunition except .30-06 is hereby implemented at the rate of 2%. Taxation on all alcohol and tobacco is 10%, and the tax rate on everything else excepting food is 4%.

Section 3- Orderly Debate

All opinions must be expressed while the party expressing said opinion is armed with a .30-06 firearm, either rifle or handgun. All parties not found in possession of a .30-06 firearm are subject to arrest by the Secret Police of NBardania (SPN).

Section 4- Mindless Junk that the Constitution Must Include

No killing, stealing, or smoking pot, dope, or any other substance that the Secret Police may deem harmful. That should cover just about everything. Any laws deemed necessary may be formulated by the SPN at any time, provided they leave adequate notice to the citizens of NBardania as determined by the Supreme Court of NBardania or El Presidente, NBarden.

Article 3- The Secret Police


The Secret Police of NBardania (hereafter referred to as SPN), shall be outfitted at the expense of the state and have the power to enforce all said laws. In addition to carrying government issued .30-06 weapons, the SPN shall also be issued 10 gauge sawed-off shotguns, tasers and hancuffs. The Super-power Weapons Anhiliation Team (hereafter referred to as SWAT) branch of the SPN shall be issued nuclear tipped rocket launchers, rocket propelled grenades, and bazookas.

ARTICLE 2. Imperialism and the Generation of Mercantilist Companies
The Imperial Republic of Drakesmark is a Mercantilist-Colonial-Imperial Republic. That is, Imperial Control is to be extended though economic and cultural assimilation rather than military force. Military force is, however, a vital part of the economic system, through the generation of Mercantilist Companies which are entrusted with certain governmental powers. [Hist. Ref. The British East India Company]. The Drakesthing Council alone has the authority to create Mercantilist Companies. (Private citizens may still create their own economic units, companies, et cetera. These companies are not Mercantilist Companies.) Controlling interest in these private Companies is invested in the Drakesthing Council at the following ratio: 60% of stock within the generated company must be owned by current members of the Drakesthing Council. 40% of stock within the generated company must be auctioned to the private citizens, and may not be owned by any member of the Drakesthing Council. In the event that the Drakesthing Council comes to own more than 60% of stock in a Mercantilist Company, that Councilmember possessing the greatest amount of stock in the Company must, immediately following the next Council session, auction the excess portion of the Company stock, not exceeding half of his or her possessed stock. If the Drakesmark Council still possesses more than 60% of the Company stock, the process must be repeated after the following Council Session.

ARTICLE 3. Exclusive Powers of the Mercantilist Companies
If a Mercantilist Company is generated, that company has the following powers which may not be violated, save by Disbanding that company (see Article 4). These powers are exclusive to Mercantilist Companies.
Freedom of Independant Governance of Company Affairs, to be controlled by Stockholders.
Freedom of Dependant Governance of Company territories.
Freedom to train, equip, and exercise military power in the following purposes: defense of company authority, defense of company property, defense of company employees, national defense, peacekeeping within company territories, and military action against non-recognized nations, insurrections, out-of-uniform combatants, and terrorists.
Freedom of Representation and Singe Vote within the Drakesmark Council.
Power of Monopoly over international trade within defined boundaries. These boundaries are defined at the creation of the Mercantilist Company, and may not be altered, except as stated in Article 4.

ARTICLE 4. Disbanding or Altering Mercantilist Companies
If a Mercantilist Company is to be disbanded or the Boundaries of Monopoly altered, the Drakesthing Council may vote to do so. In order for a Company to be disbanded or Monopoly altered, there must be a 66% majority vote to do so.

ARTICLE 5. Boundaries
Because the Imperial Republic of Drakesmark is a Mercantilist-Colonial-Imperialist nation, the boundaries thereof are undefined. The Mercantilist Companies are granted governing rights over territories they bring under their control. Thus, the boundaries are defined by the people and the assimilation of others.

ARTICLE 6. The Drakesthing Council
Will be made up of whomever AgentDrake feels like, including, but not limited to, all the voices inside his head. Foreign ambassadors and dignitaries may, on rare occasions, be admitted to the Drakesthing Council as voting members. This is to encourage interaction and explore the possibility of (not enforced policy of) assimilation, should that nation wish to become a part of Drakesmark, and [insert propagandist euphamism:] Drakesmark a part of that nation. Each Mercantilist Company also is required to contribute one voting representative. The Drakesthing Council acts in the name of the High Imperial Lord, AgentDrake.

ARTICLE 7. Taxes
There are no taxes. The Mercantilist Companies contribute directly to the Drakesthing Council via 60% stock ownership.

ARTICLE 8. Military
The Imperial Republic of Drakesmark must, at all times, maintain a technologically advanced, and strategically versatile military. [Hist. Ref.: In the past, such strategies as the regeneration of dead tissues to create plague-bearing zombie armies, the use of sleeper virus bio-weapons, and anti-matter ballistics and assassin bombs have been employed for warfare, peacekeeping, and controlling the Balance of Power.]
Mercantilist Companies may be called upon to provide military power to the nation.
The Imperial Republic will maintain a military independent of the Mercantilist Companies at all times.

ARTICLE 9. Peacekeeping
The Imperial Republic reserves the right to rain apocalypse down upon anyone who threatens to destabilize the balance of power.

ARTICLE 10. International Organizations.
The Imperial Republic of Drakesmark is one of the governing members of the international organization known as The United Moderators.
Drakesmark is loosely allied with the Order of the Shieldmaiden, an international personality cult.

ARTICLE 11. Of "Drakesnark"
Those who to mock our noble and glorious nation with the abominable name "Drakesnark" will be destroyed.

Amendments are currently working their way through a bureaucratic mess. They should attain constitutional status in 1 - 89,634 days.

El Presidente of NBardania proposes an alliance between Drakesmark and NBardania, including a mutual defense pact and a free trade agreement.

The Drakesthing Council accepts the alliance of mutual defense, subject to the standard policies of Drakesmark. AKA, if you attack someone else first, we won't necessarily back you up. But if someone goes after you without just cause, apocalypse shall rain down upon them.

As for free trade, TIR Drakesmark offers the establishment of The NBardanian Merchant Company to carry out all Drakesmark trade with NBardania. For our own benefit, our offered exchange rates will remain reasonable. The last thing TIR needs is for our Company to lose stock value when you won't trade. ;)

TIR also establishes the Imperial Exploration and Exploitation Company to seek out new life and new civilizations... to boldly go where no AD has ever gone before. (AKA, that's an open invitation for you other people to start jumping in and creating alliances, trade connections, et cetera.)

The Official Constitution of the Imperial Alliance of States

Preamble and Statement of Purpose
We the citizens, of the thirteen member states of this Alliance, do approve this document in order to bind together our states, to keep the general peace, to defend ourselves the better by unity against Tyranny, to further the well-being of this Alliance, and to preserve from chaos, fear, terror and oppression the lives of our citizens and peoples and to reassure the safety and health of those who shall follow after us.


ARTICLE 1: The Council

Part 1: The Summary of the Council

The authority of this alliance is contained, not solely, but mainly in the Council of Representatives.
The Council of Representatives shall be a entity of thirteen Councilors elected to the position of councilor, with one councilor elected from each of the thirteen member states. One member shall be chosen as the Chancellor of the Council.


Part 2: The Election of the Councilors
Every ten years, on the tenth day of the tenth month a common election will be held for the position of Councilor. A citizen may only run for an office of Councilor if he is: a member of the state of which the current councilor is representative, if he has not been prohibited from attempting public office, if he is at least thirty years of age, and if he has been a member of that state for the last thirty years. A citizen can only participate in voting if he has not been prohibited from voting, if he is at least fifteen years of age and if he has been of member of the state of which the current councilor is a representative, for at least five years.

Part 3: The Election of the Chancellor
The Chancellor of the Council is chosen ten days after the election of the members of the Council and on the day the new Council first comes into session. Those that are candidates for the position of Chancellor of the Council may announce their candidacy on the during the first three sessions of the Council and during the fourth session voting begins. Only members of the Council may vote. In case of a tie the candidate with the least support is eliminated and the voting begins anew the next time the Council is in session. The candidate with the most votes becomes the Chancellor of the Council and is instituted as such during the next session of the Council. The Chancellor of the Council can be relieved of his office if at least ten Councilors motion for his resignation during a session of the Council.

Part 4: The Rights, Responsibilities and Duties of the Council of Representatives
The rights, responsibilities and duties of the Council of Representatives are this:
To regulate the treasury
To take part in trade agreements
To create money, for use in commerce and trade
To create laws governing the Alliance as a whole, which shall be passed by a majority of the Council, unless vetoed by the Chancellor.
To establish a High Court
To create a common militia for defense of the entire Alliance
To build roads, bridges, ferries and forts and other buildings needed by the Alliance
To recognize the member states as sovereign entities grouped together only by this Alliance


Part 5: The Rights, Responsibilities and Duties of the individual Councilors
The duty to make laws governing the state represented by that Councilor
The right to appoint judges and courts over the state represented by that Councilor, as governed by that state's Constitution.
The right to commission a military for that state.


Part 6: The Rights, Responsibilities and Duties of the Chancellor of the Council
The duty to pass and or veto laws
The right to amend the Constitution
The duty to publish the Alliance's budget


ARTICLE 2: The Judicial System

Part 1: The Summary of the Judicial system
The authority of this Judicial system is founded on the authority of the Council of Representatives
and is made up of the High Court which precedes the courts of the individual states in authority.


Part 2: The High Court
The members of the High Court are chosen by members of the Council of Representatives in whatever fashion the Council so chooses.

Part 3: The Purpose of the High Court:
To uphold and enforce the laws instituted by the Council. To settle disagreements that have passed through
the lesser courts and to dispense Justice. To institute definitions of crimes to a minute degree.

Part 4: The Definition of Major Crimes
Treason: the act of giving information and engaging in activities contrary to the laws of the land, of
harboring or sheltering fugitives and any act of spying for another nation. The act of killing, or attempting to kill a member of the Council, the military, or any federal institution within
Murder: The act of terminating the life of a sentient being, born or unborn.
Theft: The act of re-appropriating property not belonging to the person in question.



ARTICLE 3: The Rights of the individual Citizen as specified by the Council

Part 1: The List of Citizens' Rights
These rights may not be altered, changed, re-written or re-interpreted in an way:
The right to defend ones self
The right to a fair trial
The right of free speech
The right of sanctity of home
The right against searches without warrant
The right to trial by jury
The right to practice any religion
The right to maintain property



ARTICLE 4: The Rights' of States

Each of the thirteen states has the right to:
Elect whatever government underneath that state's Councilor that it so wishes
Ratify its own Constitution as governed by this document
Amend its Constitution
Appoint its own Judicial System for the purpose of justice
Institute further rights for its citizens


ARTICLE 5: Modification of this Constitution

This Constitution may only be modified by the Council and even then only by a unanimous
decision by all thirteen Councilors. The Constitution may be re-ratified by the Council after changes have been made. None of the original eight Citizens' Rights may be modified in any way or removed, these rights may be added and those that have been added may be removed. None of  the Rights' of States may be modified in any way, rights may be added and those that have been added may be removed.

The government of NBardania officially thanks Drakesmark for its pro-NBardanian policies and looks forward to a period of friendly relations between the countries.

NBardania congratulates the IAS on the formation of its Republican status and wishes the Chancellor the best in his promotion of democracy. NBardania also proposes a cease-fire from the previous skirmish with the IAS and hopes that friendly relations can prosper in the region.

The Chancellor of the I.A.S. wishes to remind El Presidente that the previous skirmish was between the I.T.A. and NBardania, the I.T.A being a now-defunct entity replaced by the I.A.S. Also, the previous skirmish did end in a peace treaty and thus the Chancellor proposes a trade agreement/mutual benefit agreement with the nation of NBardania and accepts the afore-mentioned cease-fire in the hopes of suppressing hostilities of any nature and promoting peace
between our two nations.

TIR Drakesmark is pleased to announce that trade has been established with the Sovereign nation of NBardania.

Drakesmark also disengages a portion of the Imperial Exploration and Exploitation Company to become the Royal Troll Company to engage in open trade with the Imperial Alliance of States.

NBardania accepts the IAS proposal, and also proposes the formation of an NCTO (North Cobra Treaty Organization) alliance between Drakesmark, NBardania and IAS for the purpose of mutual defense, and, if necessary, aid in case of invasion.
