That's the way its supposed to work. That's not the way it actually works. The way it works is this.
Supreme Court Justices retire.
Obama appoints Supreme Court Justices, getting a majority on the court.
The Supreme Court is now the sole entity to decide what is a constitutional right and what is unconstitutional.
The Supreme Court makes the laws.
Heh, that's pretty much what happens here, as well. Can you believe they actually forbid handcuffs for conducting criminals? Because some rich guy was handcuffed, and he said it was bad for his image. Now, policemen all around the country have to JUSTIFY in written the use of a handcuff, or else THEY are punished.

So yeah, Obama is going to have a heyday for the next 4 years. Decisions I foresee...
Gun bans, increased restrictions.
Gay marriage legalized in all 50 states.
All restrictions on abortion declared unconstitutional.
Affirmative Action based on sexual orientation, banning "hate speech" against homosexuals (meaning that churches can no longer preach Scripture that says homosexuality is a sin).
Personally, I agree with all of them, in part.
Abortion is a delicate issue here, because we have Public Healthcare and all, but there, I think it'd work just fine. The last part, I agree until it gets to the parenthesis, after all, faith is faith.
And gay marriage, come on, a man and a woman can marry each other and then get to hate their own guts and be miserable for the rest of their lives, why can't two people of the same sex that ACTUALLY DO love each other have the same treatment? Now, I'm not talking about wedding ceremonies, since it deals with faith, and the government can't simply "force" the Church to interpret the Bible differently, but civil union? Why not?
