Crashed Gate.  Here's the scenario.  I am the FP player, at site 5, and my opponent has already taken the maximum number of sites before the Regroup phase.  I have no threats and 5 companions.

Regroup phase: the site gives me two options: add 3 threats, or choose an opponent, and that opponent may take control of a site if he wants to.

Problem: my opponent can't take a site.

Question: Am I forced to add 3 threats?

I say no, I chose to give my opponent a site, not my problem my opponent can't take the site.  "May" = optional.
My opponent says yes, "must" add 3 applies if he chooses not to take a site.
